Terms and Conditions

PowerVocab is operated by Pariah Group LLC. It is a vocabulary-learning application designed to help users learn, review, and expand their vocabulary through flashcards, vocabulary packs, games, quizzes, and related educational features.

PowerVocab is an educational tool. While we strive to provide accurate and useful information, we do not guarantee that every definition, pronunciation, synonym, example, or other piece of educational content is completely accurate, current, or suitable for every purpose.

You must be legally permitted to use PowerVocab under the laws applicable to you.

If you are under the age required to enter into a legally binding agreement in your jurisdiction, you may use PowerVocab only with the involvement and consent of a parent or legal guardian where required by law.

Certain features may require you to create an account.

You are responsible for:

• providing accurate information;
• maintaining the security of your account credentials;
• maintaining access to the email address associated with your account; and
• all activity occurring through your account.

You agree not to impersonate another person, create an account using false information, or attempt to access another user's account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that may harm PowerVocab, other users, or our services.

PowerVocab may provide certain features or vocabulary content free of charge and may offer additional content, features, vocabulary packs, or functionality through paid subscriptions or other purchases.

We reserve the right to modify, add, remove, or discontinue features of the Service at any time.

Changes to free features will not affect any rights that cannot legally be modified or removed.

PowerVocab may offer paid subscriptions that provide access to premium features and content.

Subscription pricing, billing frequency, trial periods, promotional pricing, and included features will be presented to you before purchase.

Subscriptions purchased through the Apple App Store or Google Play are billed and managed through the applicable platform.

Automatic Renewal

Unless otherwise stated, subscriptions are automatically renewed at the end of each billing period unless you cancel before the renewal date.

By purchasing an auto-renewing subscription, you authorize the applicable app store to charge your selected payment method for the applicable subscription fee at each renewal.

You are responsible for reviewing the renewal price and terms presented at the time of purchase.

Apple and Google require subscription offers to clearly disclose the price, billing frequency, and automatic-renewal terms.

Free Trials and Promotional Offers

PowerVocab may occasionally offer free trials, introductory pricing, discounts, or other promotional offers.

Unless otherwise stated, when a free trial or promotional period ends, the subscription will automatically renew at the applicable regular subscription price.

Eligibility for promotional offers may be determined by PowerVocab and/or the applicable app store.

You may cancel your subscription at any time through the platform on which you purchased it.

Deleting the PowerVocab application does not automatically cancel your subscription.

If you cancel an active subscription, you will generally retain access to the applicable paid features until the end of your current paid billing period, unless otherwise determined by the applicable platform or required by law.

Google Play likewise states that uninstalling an app does not cancel its subscription.

All purchases made through the Apple App Store or Google Play are subject to the applicable platform's payment, refund, and billing policies.

PowerVocab does not control payment processing performed by Apple or Google.

Refund requests for purchases made through an app store may need to be submitted directly to the applicable platform.

Nothing in these Terms limits any refund rights or other consumer rights that cannot legally be excluded under applicable law.

PowerVocab may change subscription pricing from time to time.

Where required, users will receive notice of applicable price changes through the relevant platform or other appropriate means.

Continued use of a subscription after a price change takes effect constitutes acceptance of the new price where permitted by applicable law.

PowerVocab and its original content, features, design, software, branding, logos, graphics, user interface, and other materials are owned by or licensed to Pariah Group LLC and are protected by applicable intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use PowerVocab for your personal, non-commercial use.

You may not:

• copy, reproduce, or redistribute PowerVocab or its content;
• sell, sublicense, rent, lease, or commercially exploit the Service;
• modify or create derivative works from the Service;
• reverse engineer, decompile, or attempt to extract source code from the application except where expressly permitted by law;
• systematically scrape or harvest vocabulary content or other Service data;
• remove copyright, trademark, or other proprietary notices; or
• use PowerVocab to create or develop a competing product or service.

You agree not to use PowerVocab to:

• violate applicable laws or regulations;
• interfere with or disrupt the Service;
• attempt unauthorized access to PowerVocab systems or accounts;
• circumvent subscription restrictions or other access controls;
• exploit bugs, vulnerabilities, or technical errors;
• use automated systems to scrape or collect substantial amounts of Service content; or
• engage in activity that could damage PowerVocab or its users.

PowerVocab is provided for general educational and informational purposes.

Vocabulary definitions, pronunciations, synonyms, examples, and other educational material may contain errors or omissions.

PowerVocab does not guarantee that information provided through the Service will meet your particular educational, professional, academic, or other requirements.

You are responsible for independently evaluating information when accuracy is important.

PowerVocab may rely on third-party services, platforms, technologies, or providers to operate certain portions of the Service.

These may include app stores, payment processors, hosting providers, analytics services, authentication providers, content providers, and other technology providers.

Your use of third-party services may be subject to their separate terms and privacy policies.

PowerVocab is not responsible for the independent practices, availability, or policies of third-party services.

We strive to keep PowerVocab available and functioning properly, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable due to maintenance, updates, technical problems, outages, or circumstances outside our reasonable control.

We may modify, suspend, or discontinue portions of PowerVocab at any time.

To the maximum extent permitted by applicable law, PowerVocab is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, reliability, or non-infringement.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Pariah Group LLC, its owners, officers, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of PowerVocab.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the greater of:

1. the amount you paid to PowerVocab for the Service during the twelve (12) months immediately preceding the event giving rise to the claim; or
2. one hundred U.S. dollars (US $100).

Nothing in these Terms limits liability that cannot legally be limited or excluded.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Pariah Group LLC, its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• your violation of these Terms;
• your misuse of PowerVocab;
• your violation of applicable law; or
• your infringement of another person's rights.

We may suspend or terminate your access to PowerVocab if you materially violate these Terms, engage in fraudulent or abusive conduct, or use the Service in a manner that creates legal, security, or operational risk.

You may stop using PowerVocab at any time.

Termination does not automatically entitle you to a refund of amounts already paid, except where required by applicable law or the applicable app store's refund policies.

Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will survive termination.

Your use of PowerVocab is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information.

These Terms will be governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, except to the extent that applicable consumer-protection laws require otherwise.

Any dispute arising from these Terms or your use of PowerVocab will be handled in the courts having appropriate jurisdiction, subject to any mandatory rights or remedies available to consumers under applicable law.

We may update these Terms from time to time.

When we make material changes, we may provide notice through PowerVocab, our website, or other reasonable means.

The updated Terms will become effective on the date stated at the beginning of the revised Terms.

Your continued use of PowerVocab after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
